Agreement to terms

By creating an account or using OwnerFi, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the platform. We may update these terms from time to time; the latest version will always be available on this page.

Who may use OwnerFi

You must be at least 18 years old and legally able to enter into a binding agreement. You may register as a seller, a buyer, or both. You are responsible for keeping your account credentials secure and for all activity under your account.

Our role: facilitator, not a party to the sale

OwnerFi is a marketplace facilitator. The vehicle and the financing agreement are between you and the other party. OwnerFi does not buy, sell, or take title to vehicles, and never holds or touches funds. Money movement is handled by a regulated third-party payment provider. That means the seller and buyer bear the responsibilities of the sale and the financing between themselves.

Fees

OwnerFi charges a platform fee of 10% on every transaction, collected automatically on each completed transaction and recurring payment. Fees are disclosed before you confirm a transaction. OwnerFi is not responsible for taxes owed by users on their activities.

Deals

A deal proceeds through a defined pipeline: Inquiry → Test Drive → Negotiation → Application → Contract → Completed. Each stage reflects the current state of the deal between the parties. Either party may end a deal before it is completed in accordance with the platform's rules and applicable law.

Payments

Recurring monthly payments are collected automatically at each billing cycle through our payment provider. OwnerFi does not store your card or bank details. You are responsible for ensuring your payment method stays valid and for any fees, including late fees, set out in your deal agreement.

Prohibited conduct

• Posting false, misleading, or fraudulent listings.
• Attempting to transact outside the platform to avoid fees.
• Harassing, threatening, or defrauding other users.
• Misusing another person's account or personal data.
• Circumventing platform security or exceeding your access.

No warranty and limitation of liability

OwnerFi provides the platform on an “as is” and “as available” basis. We do not guarantee the condition of any vehicle, the accuracy of listings, or the outcome of any deal. To the fullest extent permitted by law, OwnerFi's aggregate liability arising out of or related to the platform is limited to the fees you have paid to OwnerFi in the twelve (12) months preceding the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

Termination and suspension

You may close your account at any time. We may suspend or terminate your access if you violate these terms, break the law, or otherwise harm the platform or other users. Termination does not relieve you of obligations under deals already in progress.

Governing law

These terms are governed by the laws of the jurisdiction in which OwnerFi is established, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction, unless otherwise required by applicable consumer law in your location.
